here’s how to get started:
1. Discuss the idea with the other party.
Share the information on this website and explore whether both of you are open to resolving your separation or divorce collaboratively.
2. Arrange an initial meeting with a Collaborative Lawyer
In the collaborative process, the lawyers work as part of a team, so it can be helpful for both of you to participate in choosing legal counsel. Selecting lawyers who are familiar with collaborative practice and have experience working together can support clearer communication and more efficient process focused on your priorities.
Lawyers who regularly practice collaboratively are generally familiar with one another’s approach and expectations, which can reduce unnecessary conflict and keep discussions productive. A list of lawyers who practice collaborative law in the Kootenays is available on our About Page.
3. Attend your first four-way meeting
After each of you has met privately with your respective lawyer, you’ll come together with both lawyers for the first collaborative meeting. The participation agreement is usually signed at this stage.
4. Work toward resolution and final agreement
Through a series of four-way meetings, all legal issues are discussed and resolved by mutual agreement. Once everything is settled, one of the lawyers will prepare a separation agreement, which can be filed with the court as a final order if required.
